In its Annex II the revised Waste Framework Directive (2008/98/EG) lists waste recovery operations. The entry R1 covers operation where waste is used “principally as a fuel or other means to generate energy”. A footnote to this entry explains further that this includes incineration facilities dedicated to the processing of municipal solid waste only where their energy efficiency is equal to or above a certain level.

It is the objective of the project to identify uncertainties of the formula established by the footnote of Annex II of the Waste Framework Directive and problems with its practical implementation.
